Protecting your personal information is very important to Moxion Power, Inc. (“Moxion Power”, “we”, “us” or “our”). This Privacy Policy is meant to explain and help you understand (i) what information we collect, and how we use and share the information we collect from or about you via all digital or online properties or services that link to this Privacy Policy, including our websites, https://www.moxionpower.com/, https://app.moxionpower.com/ and https://go.moxionpower.com/ (“Sites”)), via our mobile applications, mobile devices, through written or verbal communications with us, when you visit one of our field sites, or from other sources, and (ii) your rights and options with regard to personal information we collect. Please read and review this Privacy Policy in its entirety before using our Sites, our mobile applications, or submitting your personal information to us.
1. INFORMATION WE COLLECT
We collect Personal Information that you provide to us, including information you submit to us when you use the Sites or our mobile applications, rent equipment or purchase other products or services from us. As you navigate through and interact with the Sites or use mobile applications, we may use automatic data collection technologies to collect certain information about your equipment, online activities and browsing actions and patterns. We may collect this information directly or through third parties, including operating systems and platforms, social networks, or data analytics providers.
We may collect the following Personal Information over the last 12 months:
- Contact information and identifiers such as your name, job title, address, email address, telephone number, unique personal identifiers, online identifiers, and IP address, in order to provide you with our products and services, and unique device identifiers when you visit our websites or use our mobile applications.
- Identification or verification information such as driver’s license number and federal tax identification number.
- Payment information such as your billing address and payment methods.
- Transaction history such as rental and purchase information, order history, and product interests.
- Communications information such as email messages, voice recordings, call transcripts and information that you share when you call our customer care center and SMS records and message content.
- Commercial information, including records of products and services obtained from Moxion Power and information about your purchasing preferences.
- Professional or employment-related information, in the form of business contact information and as noted.
- Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with our Site, mobile applications, social media platforms, and advertisements.
- Geolocation data in the form of the location of our rental equipment and devices. This includes the geolocation of the rental equipment and devices during your use of them.
- Feedback such as survey responses, reviews, or comments you submit to us regarding our products or services.
The technologies we use for automatic data collection on the Sites or our mobile applications include cookies and web beacons. A cookie is a small text file placed on your device. A web beacon is a small electronic file (e.g., clear gifs, pixel tags and single-pixel gifs) with a unique identifier that is used to understand browsing activity. We use data collected through these technologies, which we may supplement with other information such as location, to help us improve the Sites and to deliver a better and more personalized service.
Third-Party cookies. We do not permit third parties to collect Personal Information through cookies or other tools on our Sites concerning your online activities over time across different websites for the third parties’ own purposes. Most web browsers automatically accept cookies but you can usually modify your browser settings to decline cookies but doing so may prevent you from accessing all functionality of the Sites.
2. LINKED SITES.
The Sites may occasionally include links to other websites or content that belong to third parties that we think you may enjoy or are helpful, including plug-ins that link to social media sites such as LinkedIn, Facebook, X (formerly Twitter), YouTube, and Instagram. These sites operate independently of Moxion Power and we are not responsible for Personal Information that you voluntarily disclose to these sites. 3. HOW WE USE YOUR INFORMATION
We may use Personal Information we collect to:
- Provide you with the Sites as well as with information, products or services that you request from us.
- Complete transactions, including your rental or purchase of products and services.
- Provide customer and account services, such as notices regarding products and services or your account/subscription, including expiration and renewal notices.
- Comply with applicable laws, cooperate with investigations by law enforcement, and/or pursue our legal rights, including performing and enforcing our contractual obligations and rights, such as billing and collection.
- Evaluate and improve our products and services and/or develop new products or services.
- Tailor our marketing and advertising to you.
- We may also use your Personal Information to contact you about our own and third-parties' goods and services that may be of interest to you. 4. HOW WE SHARE YOUR INFORMATION
We may disclose aggregated information about our users and information that does not identify any individual, without restriction.
We may disclose Personal Information as described in this Policy to the following:
- Contractors, service providers and other third parties we use to support our business and provide you with our products and services. These include but are not limited to companies that process, store or transmit credit card information and who are bound by contractual obligations to keep Personal Information confidential and secure, and to use it only for the purposes for which it is disclosed to them.
- Our customers in connection with services we provide to them, including information related to driver and operator behaviors that occur during the use of the rented or purchased equipment.
- Buyers or other successors in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding in which Personal Information held by us is among the assets transferred.
- Government entities or other parties to comply with court order, law or legal process, including responding to a government, court or regulatory request.
- Government entities, third-party cybersecurity experts or other parties as necessary and appropriate to ensure the security and integrity of our networks, or otherwise protect the rights, property or safety of Moxion Power, our customers or others.
- Third-party entities to enforce or apply our terms of use and other agreements or otherwise protect or assert our legal rights, including for billing and collection purposes.
We may also disclose your Personal Information with your consent or for any other purpose disclosed by us when you provide the information.

5. OPTIONS ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION
We have created mechanisms to provide you with options regarding the Personal Information you provide to us as follows:

- Promotional Offers from Moxion Power. If you do not wish to have your Personal Information used by Moxion Power to promote our own or third parties' products or services, you can opt-out by contacting us (see How to Exercise Your Rights or Contact Us below for details on how to contact us). This opt out does not apply to information provided to Moxion Power as a result of a product purchase, warranty registration, product service experience or other transactions.
- Targeted Advertising. If you do not want us to use information that we directly or indirectly collect or that you provide to us to deliver our advertisements, you can opt-out by contacting us (see How to Exercise These Rights or Contact Us below for details on how to contact us). 6. PRIVACY FOR CHILDREN UNDER THE AGE OF 18
The content of the Sites is not targeted to or intended for children under 18 years of age. Moxion Power does not market products or services to this age group and does not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on the Sites or on or through any features on the Sites, or provide any information about yourself to us, including your name, address, telephone number, or e-mail address. If we learn we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. 7. CALIFORNIA PRIVACY RIGHTS
Residents of California may have the right to: (1) know what Personal Information we collect, use, disclose, and sell; (2) request that we delete your Personal Information; (3) access and obtain a copy of your Personal Information that we collect; (4) request correction of inaccurate Personal Information; (5) opt out of the sale or sharing of your Personal Information; or (6) limit the use and disclosure of certain sensitive information. Certain Personal Information is considered “sensitive information” under the California Consumer Privacy Act and unless otherwise stated, we do not collect or retain sensitive information. In addition, we may not discriminate against you for exercising any of your rights. We will honor your request to the extent required by applicable law and will make a good faith effort to honor your request in all other cases.
If you disagree with our response to your request, you may appeal the request by submitting supporting documentation to privacy@moxionpower.com.
With respect to deletion requests, you can request that we and our service providers delete all Personal Information collected from you. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Please note that we may take steps to verify your identity before granting you access to information or acting on your request to exercise your rights, as required or permitted by law. We may limit our response to your exercise of the above rights as permitted by law.
You may designate an authorized agent to exercise the foregoing rights on your behalf. An agent may be an individual or a business entity registered with your Secretary of State. To designate an authorized agent, you must provide the agent with written permission to submit the request. We may still require you to verify your identity directly (subject to certain exceptions). We may refuse a request if the agent does not provide adequate proof of their authorization.
9. HOW WE KEEP YOUR INFORMATION SECURE
We have implemented measures designed to secure your information. For example, we require our payment processing merchants to comply with the Payment Card Industry Data Security Standards. Moreover, we require that any third parties that process your information on our behalf comply with a comprehensive set of security requirements. However, we cannot guarantee that your Personal Information will never be disclosed in a manner inconsistent with this Privacy Policy (for example, as a result of unauthorized acts by third parties that violate applicable law or relevant Web policies).
10. DO NOT TRACK
Please note that our Sites and mobile apps are not designed to respond to "do not track" requests from Web browsers.
11. UPDATES TO OUR PRIVACY POLICY
We may make changes to this Policy from time to time. When we make material changes to this Policy, we will post the revised Policy with the date of the last revision. Any changes to this Policy will become effective upon posting of the revised Policy on the Sites. We encourage you to review our privacy policy periodically.
